General Data Protection Regulation (GDPR)

This definition encompasses obvious identifiers such as names and identification numbers but extends to location data, online identifiers, IP addresses, cookie identifiers, and any factor specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that person. Special categories of personal data, including biometric data, health data, and data revealing racial or ethnic origin, receive heightened protection.
The regulation distinguishes between data controllers, who determine the purposes and means of processing personal data, and data processors, who process data on behalf of controllers. Electronics manufacturers typically act as controllers when they collect data directly from device users, but may act as processors when providing services to other organizations. Both roles carry specific obligations under GDPR, and the relationships between controllers and processors must be governed by written contracts meeting prescribed requirements.
Lawful Bases for Processing
GDPR requires that all processing of personal data be based on one of six lawful bases specified in Article 6. Consent requires a freely given, specific, informed, and unambiguous indication of the data subject's agreement, typically through a clear affirmative action. Contract necessity permits processing required for the performance of a contract with the data subject or to take pre-contractual steps at their request. Vital interests permit processing necessary to protect the life of the data subject or another person. Public task applies to processing necessary for performing tasks carried out in the public interest or in the exercise of official authority. Legitimate interests, the most flexible basis, allows processing necessary for the purposes of legitimate interests pursued by the controller or a third party, except where overridden by the interests or fundamental rights of the data subject, particularly where the data subject is a child.
For electronics applications, consent and legitimate interests are the most commonly invoked bases, though contract necessity applies when data processing is essential for device functionality. Processing special category data requires meeting additional conditions under Article 9, with explicit consent being the most common basis. The choice of lawful basis has significant implications for data subject rights and should be determined before processing begins and documented in privacy notices and records of processing activities.
Data Subject Rights
GDPR establishes comprehensive rights for data subjects that organizations must respect and facilitate. The right of access enables individuals to obtain confirmation of whether their personal data is being processed and, if so, access to that data along with information about the purposes, categories, recipients, retention periods, and source of the data. The right to rectification allows data subjects to have inaccurate personal data corrected and incomplete data completed.
The right to erasure, often called the right to be forgotten, requires controllers to delete personal data when it is no longer necessary for its original purpose, when consent is withdrawn, when the data subject objects and there are no overriding legitimate grounds, when processing is unlawful, when deletion is required by law, or when data was collected in relation to the offer of information society services to a child. The right to restriction of processing allows data subjects to limit processing in certain circumstances, such as during verification of data accuracy or assessment of a legitimate interest objection.
Data portability requires controllers to provide personal data in a structured, commonly used, and machine-readable format when processing is based on consent or contract and carried out by automated means. The right to object allows data subjects to object to processing based on legitimate interests or public task, requiring the controller to stop processing unless demonstrating compelling legitimate grounds. Automated decision-making provisions grant data subjects the right not to be subject to decisions based solely on automated processing, including profiling, that produce legal or similarly significant effects, with limited exceptions.
Controller and Processor Obligations
Data controllers bear primary responsibility for ensuring GDPR compliance, implementing appropriate technical and organizational measures to ensure and demonstrate that processing complies with the regulation. Controllers must implement data protection by design and by default, ensuring that only personal data necessary for each specific purpose is processed and that data is not made accessible to an indefinite number of persons without individual intervention. Privacy impact assessments are mandatory for processing likely to result in high risk to data subjects.
Records of processing activities must document all processing operations, including purposes, data categories, recipients, transfers to third countries, retention periods, and security measures. Controllers processing data on a large scale or processing special categories of data must designate a Data Protection Officer. Security obligations require implementing appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including pseudonymization and encryption, the ability to ensure ongoing confidentiality, integrity, availability, and resilience of processing systems, and procedures for regular testing.
Data processors must process personal data only on documented instructions from the controller, ensure that persons authorized to process data have committed to confidentiality, implement appropriate security measures, engage sub-processors only with controller authorization and through contracts imposing equivalent obligations, assist the controller in fulfilling data subject rights and other obligations, delete or return all personal data at the end of the service relationship, and make available information necessary to demonstrate compliance.
Enforcement and Penalties
GDPR establishes a tiered system of administrative fines that can reach substantial amounts. The lower tier, applying to violations of provisions concerning controllers and processors, certification, and monitoring bodies, allows fines up to ten million euros or two percent of total worldwide annual turnover, whichever is higher. California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA)
Scope and Applicability
The California Consumer Privacy Act, effective January 1, 2020, and substantially amended by the California Privacy Rights Act effective January 1, 2023, establishes comprehensive privacy rights for California residents and obligations for businesses that collect their personal information. The law applies to for-profit entities doing business in California that meet any of three thresholds: annual gross revenue exceeding twenty-five million dollars, annual buying, selling, or sharing of personal information of 100,000 or more consumers or households, or deriving fifty percent or more of annual revenue from selling or sharing personal information.
CCPA/CPRA defines personal information broadly as information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. This includes not only traditional identifiers but also internet activity, geolocation data, biometric information, professional or employment information, education information, and inferences drawn to create consumer profiles. Sensitive personal information, a category added by CPRA, receives heightened protection and includes government identifiers, financial account information, precise geolocation, racial or ethnic origin, religious beliefs, genetic data, biometric data for identification, health information, sex life or sexual orientation information, and contents of communications.
The law distinguishes between businesses, which are comparable to GDPR controllers, and service providers and contractors, which are comparable to processors. Service providers may process personal information only on behalf of and subject to written contracts with businesses, while contractors face additional requirements including certification that they understand and will comply with restrictions on use and disclosure. Unlike GDPR, CCPA/CPRA does not apply to nonprofit organizations or government agencies, though separate laws may govern their data practices.
Consumer Rights
CCPA/CPRA establishes rights that California consumers may exercise against covered businesses. The right to know requires businesses, upon verifiable consumer request, to disclose the categories and specific pieces of personal information collected, the sources of that information, the business or commercial purposes for collection, and the categories of third parties with whom information is shared. The right to delete requires businesses to delete personal information upon consumer request, subject to specified exceptions for legal obligations, security incident investigation, certain internal uses, and other purposes.
The right to opt out of sale or sharing allows consumers to direct businesses not to sell their personal information to third parties or share it for cross-context behavioral advertising. Businesses that sell or share personal information must provide a clear and conspicuous link on their homepage titled "Do Not Sell or Share My Personal Information." The right to limit use of sensitive personal information allows consumers to direct businesses to use sensitive personal information only for purposes necessary to perform services or provide goods, excluding purposes such as profiling or targeted advertising.
CPRA added additional rights including the right to correct inaccurate personal information and the right to access information about automated decision-making and to opt out of such decision-making in certain circumstances. The right to non-discrimination prohibits businesses from discriminating against consumers who exercise their privacy rights, though businesses may offer financial incentives for data collection or retention if reasonably related to the value of the consumer's data. These rights may be exercised through designated request methods that businesses must establish and publicize.
Business Obligations
Covered businesses must implement several operational requirements to comply with CCPA/CPRA. Privacy notices must be provided at or before the point of collection, disclosing the categories of personal information collected and the purposes for which they will be used. A comprehensive privacy policy must describe consumer rights, the categories of personal information collected, sold, or shared in the preceding twelve months, and how consumers may submit requests. Businesses must establish at least two designated methods for submitting consumer requests, including at minimum a toll-free telephone number and, for businesses with websites, a web form.
Businesses must respond to consumer requests within forty-five days, with the possibility of a forty-five-day extension if reasonably necessary. Verification of consumer identity is required before responding to requests, using reasonable methods appropriate to the sensitivity of the information and the risk of unauthorized disclosure. Businesses must maintain records of consumer requests and responses for at least twenty-four months and make these records available to the California Privacy Protection Agency upon request.
Data minimization requirements obligate businesses to limit collection, use, retention, and sharing of personal information to what is reasonably necessary and proportionate to achieve the purposes for which it was collected or processed. Purpose limitation requires that personal information collected for a particular purpose not be used for additional materially incompatible purposes without consumer notice and, for sensitive personal information, consent. Security requirements obligate businesses to implement reasonable security procedures and practices appropriate to the nature of the information.
Enforcement and Penalties
CCPA enforcement originally resided exclusively with the California Attorney General, but CPRA established the California Privacy Protection Agency as the primary enforcement authority, the first dedicated data protection agency in the United States. The agency has authority to investigate possible violations, bring administrative enforcement actions, impose administrative fines, and issue regulations interpreting and implementing the law. The Attorney General retains concurrent enforcement authority and may bring civil actions seeking injunctive relief and civil penalties.
Civil penalties for CCPA/CPRA violations can reach $2,500 per violation for unintentional violations and $7,500 per violation for intentional violations or violations involving minors. Brazil's Lei Geral de Protecao de Dados (LGPD)
Framework and Scope
Brazil's General Data Protection Law, known as the Lei Geral de Protecao de Dados or LGPD, took effect in September 2020, establishing a comprehensive data protection framework modeled substantially on GDPR. The law applies to any processing of personal data carried out in Brazil, where the processing activity has the purpose of offering or supplying goods or services to individuals located in Brazil, or where the personal data subject to processing was collected in Brazil. Like GDPR, LGPD has extraterritorial reach, applying to foreign organizations that process data of individuals in Brazil.
LGPD defines personal data as information related to an identified or identifiable natural person, and sensitive personal data as data concerning racial or ethnic origin, religious conviction, political opinion, trade union or religious, philosophical or political organization membership, health or sex life data, genetic or biometric data when linked to a natural person. The law distinguishes between controllers, who make decisions regarding the processing of personal data, and operators, who process personal data on behalf of controllers. Both roles carry specific obligations under the law.
The Autoridade Nacional de Protecao de Dados (ANPD) serves as Brazil's data protection authority, responsible for implementing and enforcing LGPD. The ANPD issues guidance and regulations, conducts investigations, applies sanctions, and represents Brazil in international data protection matters. Since its establishment, the ANPD has actively developed interpretive guidance and enforcement procedures, building Brazil's data protection enforcement infrastructure.
Legal Bases and Principles
LGPD permits personal data processing only when based on one of ten legal bases specified in the law. These include consent, compliance with legal or regulatory obligations, public administration execution of public policies, research by research entities with anonymization where possible, contract execution at the data subject's request, exercise of rights in judicial, administrative, or arbitration procedures, protection of life or physical safety, health protection in procedures by health professionals or entities, legitimate interests, and credit protection.
Processing sensitive personal data requires a more limited set of legal bases: explicit and specific consent, legal or regulatory compliance without consent where indispensable, shared data necessary for public policy execution, research with anonymization where possible, exercise of rights in legal proceedings, protection of life or physical safety, health protection in procedures by health professionals, and prevention of fraud and data subject security in identification and authentication processes.
LGPD establishes ten processing principles that controllers must observe: purpose, adequacy, necessity, free access, data quality, transparency, security, prevention, non-discrimination, and accountability. These principles require that processing be limited to legitimate, specific, and explicit purposes disclosed to data subjects, that processing be compatible with disclosed purposes, that processing be limited to what is necessary, that data subjects have free and easy access to their data, that data be accurate and up-to-date, that information about processing be clear and accessible, that technical and administrative measures protect data from unauthorized access and incidents, that measures prevent damages from data processing be adopted, that processing not be used for discriminatory purposes, and that controllers demonstrate compliance.
Data Subject Rights
LGPD grants data subjects comprehensive rights that controllers must respect and facilitate. These include the right to confirmation of the existence of processing, access to data, correction of incomplete, inaccurate, or outdated data, anonymization, blocking, or elimination of unnecessary or excessive data or data processed in violation of LGPD, portability to another service or product provider, elimination of personal data processed with consent, information about public and private entities with which the controller has shared data, information about the possibility of denying consent and the consequences thereof, and revocation of consent.
Controllers must respond to data subject requests clearly, adequately, and within a reasonable time, in simplified format immediately upon request or in detailed format within fifteen days. When requests cannot be fulfilled immediately, the controller must provide a reasoned response explaining the factual or legal impediments. Data subjects may petition the ANPD if they believe their rights are not being respected, and the authority may conduct investigations and impose sanctions as appropriate.
Unlike GDPR, LGPD does not explicitly provide a right to object to processing based on legitimate interests or a right regarding automated decision-making, though the ANPD has authority to address these matters through regulation. The law does require human review of decisions made solely on the basis of automated processing of personal data that affect data subject interests, including decisions defining personal, professional, consumer, or credit profiles.
International Transfers and Enforcement
LGPD permits international transfers of personal data only under specified conditions: to countries or international organizations that provide an adequate level of protection, where the controller demonstrates through specific contract clauses, standard contractual clauses, global corporate rules, regularly issued certificates, or codes of conduct that appropriate safeguards are in place, where the transfer is necessary for international legal cooperation, for protection of life or physical safety, for policy execution, where the data subject has given specific and prominent consent to the transfer, or for compliance with legal or regulatory obligations or contract execution.
The ANPD has authority to define the content of standard contractual clauses and assess adequacy of protection provided by other countries and international organizations. Until the ANPD makes adequacy determinations and approves transfer mechanisms, organizations have relied primarily on specific consent and appropriate safeguards through contractual arrangements. The ANPD continues to develop guidance on international transfers as Brazil's data protection framework matures.
LGPD establishes a graduated system of administrative sanctions, including warnings, fines up to two percent of a legal entity's revenue in Brazil in the last fiscal year, excluding taxes, limited to fifty million reais per violation, daily fines, publication of the violation after confirmation, blocking of personal data until regularization, and elimination of personal data. The ANPD considers several factors in determining sanctions, including the gravity and nature of violations, good faith, economic condition, recidivism, degree of harm, cooperation by the violator, and measures adopted to minimize effects.
Canada's Personal Information Protection and Electronic Documents Act (PIPEDA)
Framework and Application
The Personal Information Protection and Electronic Documents Act, or PIPEDA, governs how private sector organizations collect, use, and disclose personal information in the course of commercial activities across Canada. The law applies to personal information that organizations collect, use, or disclose in the course of commercial activities, and to personal information about employees of federal works, undertakings, or businesses. PIPEDA does not apply in provinces that have enacted substantially similar legislation, including British Columbia, Alberta, and Quebec, though those provincial laws share many common features with PIPEDA.
PIPEDA defines personal information as information about an identifiable individual, excluding business contact information used for business purposes. The definition is broad and technology-neutral, encompassing any factual or subjective information that can be linked to an individual. The law does not create a separate category of sensitive personal information, though it recognizes that certain types of information, such as health information, financial information, and information concerning children, merit additional protection.
The Office of the Privacy Commissioner of Canada oversees PIPEDA compliance, investigating complaints, conducting audits, publishing guidance, and making recommendations to Parliament. While the Commissioner can recommend remedies and publicize findings, enforcement authority is limited, with court action required to obtain orders compelling compliance or awarding damages. Current legislative reform proposals would strengthen enforcement powers and align PIPEDA more closely with international standards.
Fair Information Principles
PIPEDA incorporates ten fair information principles that organizations must follow when handling personal information. Accountability requires organizations to designate an individual or individuals responsible for compliance and to implement policies and practices to give effect to the principles. Identifying purposes requires that purposes for collection be identified at or before the time of collection. Consent requires knowledge and consent for collection, use, or disclosure, subject to limited exceptions.
Limiting collection requires that collection be limited to what is necessary for the identified purposes and be by fair and lawful means. Limiting use, disclosure, and retention prohibits use or disclosure for purposes other than those for which it was collected, except with consent or as required by law, and requires retention only as long as necessary. Accuracy requires that personal information be as accurate, complete, and up-to-date as necessary for purposes of use.
Safeguards require protection by security safeguards appropriate to the sensitivity of the information. Openness requires that organizations make readily available specific information about their policies and practices relating to management of personal information. Individual access gives individuals the right to access their personal information and challenge its accuracy and completeness. Challenging compliance enables individuals to challenge compliance with these principles to the designated individual or individuals within an organization.
Consent Requirements
Consent is the cornerstone of PIPEDA, requiring that individuals know about and consent to the collection, use, and disclosure of their personal information, with limited exceptions. The form of consent may vary depending on circumstances and the sensitivity of information: express consent is generally required for sensitive information, while implied consent may suffice for less sensitive information where collection, use, or disclosure would be considered reasonable in the circumstances.
PIPEDA requires that consent be meaningful, which means individuals must understand what they are consenting to. Organizations must explain in plain language what personal information they are collecting, with whom they are sharing it, and for what purposes. Terms of service and privacy policies must be clear, understandable, and readily accessible. Organizations cannot require consent to collection, use, or disclosure beyond what is necessary to provide a product or service as a condition of that product or service.
Consent can be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice. Organizations must inform individuals of the implications of withdrawing consent. Consent is not required for collection, use, or disclosure in certain circumstances, including business transactions, employment relationships, legal requirements, emergencies, certain research purposes, and where obtaining consent would compromise the availability or accuracy of information and collection is reasonable for an investigation.
Breach Notification and Cross-Border Transfers
PIPEDA requires organizations to report to the Privacy Commissioner any breach of security safeguards involving personal information that creates a real risk of significant harm to individuals. The assessment of significant harm considers the sensitivity of the information and the probability that the information has been, is being, or will be misused. Organizations must also notify affected individuals and, in some cases, other organizations that may be able to reduce the risk of harm.
Breach reports must be submitted as soon as feasible after the organization determines that a breach has occurred and that the significant harm threshold is met. Notices to individuals must contain sufficient information to allow them to understand the significance of the breach and take steps to reduce risk of harm. Organizations must maintain records of all breaches of security safeguards regardless of whether reporting thresholds are met, and these records must be available to the Commissioner upon request.
PIPEDA does not prohibit transfers of personal information outside Canada but requires that organizations remain accountable for personal information transferred to third parties, including those outside Canada. Organizations must use contractual or other means to ensure comparable protection while information is being processed by third parties and must inform individuals that their information may be processed in a foreign country and may be accessible to law enforcement and national security authorities of that jurisdiction.
Japan's Act on the Protection of Personal Information (APPI)
Overview and Recent Amendments
Japan's Act on the Protection of Personal Information, or APPI, originally enacted in 2003 and substantially amended in 2015, 2020, and 2021, establishes Japan's comprehensive framework for personal data protection. The law applies to business operators that handle personal information databases in Japan, regardless of whether the operator is located in Japan. The 2020 amendments, effective April 2022, significantly strengthened individual rights, expanded obligations regarding data breaches and cross-border transfers, and enhanced enforcement mechanisms.
APPI defines personal information as information relating to a living individual that can identify the specific individual by name, date of birth, or other description contained in the information, or that contains an individual identification code. Individual identification codes include biometric data such as fingerprints, facial recognition data, iris patterns, and voiceprints, as well as identification numbers assigned by public authorities or to individuals as service users. Special care-required personal information, analogous to GDPR's special categories, includes data concerning race, creed, social status, medical history, criminal record, and being a crime victim.
The Personal Information Protection Commission (PPC) serves as Japan's data protection authority, responsible for supervision, guidance, and enforcement of APPI. The PPC has authority to conduct on-site inspections, issue guidance, orders, and recommendations, and impose administrative penalties. The Commission also participates in international data protection cooperation and has concluded mutual adequacy arrangements with the European Union allowing data transfers between Japan and EU member states without additional safeguards.
Obligations of Business Operators
Business operators handling personal information must specify purposes of use to the extent possible and limit handling to the scope necessary to achieve those purposes. Purposes of use must be publicly announced or notified to individuals, and use may not exceed the specified scope without obtaining consent. Personal information must be acquired by proper means, with sensitive information requiring explicit consent for acquisition. Operators must take necessary and appropriate measures for security control of personal data and supervise employees and subcontractors who handle personal data.
The 2020 amendments introduced new obligations including requirements to delete personal data when no longer necessary for use purposes, restrictions on providing personal data to third parties in foreign countries without appropriate consent or safeguards, and obligations to notify individuals and the PPC of data breaches that may harm individual rights and interests. Business operators must also respond to individual requests for access, correction, cessation of use, and deletion within specified timeframes.
Anonymous processed information, comparable to pseudonymized data under GDPR, may be used without individual consent under conditions including that the original personal information cannot be restored and that the information is not combined with other information to re-identify individuals. The 2020 amendments created a new category of pseudonymously processed information that can be used for internal analysis without consent but with restrictions on combining with other data and disclosure to third parties.
Individual Rights
APPI grants individuals the right to request disclosure of retained personal data, which must be provided in a manner specified by the individual, typically in writing or electromagnetic records. Individuals may request correction, addition, or deletion of inaccurate retained personal data, and operators must investigate and respond within a reasonable period. The 2020 amendments expanded the right to request cessation of use and deletion to situations where the data is no longer necessary, where a security incident has occurred, or where the handling would harm the individual's rights or legitimate interests.
Individuals may request that operators cease providing their retained personal data to third parties if the provision was obtained through deception or other improper means, or if the provision harms the individual's rights or legitimate interests. When operators receive requests, they must conduct necessary investigations and, based on the results, take appropriate measures including cessation of use, deletion, or cessation of third-party provision. Operators must notify the individual of the measures taken or the reasons for not taking measures.
The 2020 amendments strengthened enforcement by enabling individuals to bring claims against APPI violations and by authorizing the PPC to impose administrative fines.
